Under the California Safe Cosmetics Act of 2005 (CSCA) and the Cosmetics Fragrance & Flavor Ingredient Right to Know Act of 2020 (CFFRIKA), any cosmetic product sold in California, which contains an ingredient recognized as potentially hazardous must be reported. Recently, the list of ingredients to be reported (known as “the Reportable Ingredients List”) has been updated and is effective since January 1, 2022.
Here is a checklist of actions to undertake to make sure you comply with the new requirements:
Make sure you’re required to register your ingredients by answering the following questions:
- Does your company make $1,000,000 or more annually in worldwide aggregate cosmetic sales?
- Does your company’s name appear on the label of a cosmetic product sold in California after January 1, 2007?
- Does your company’s cosmetics contain ingredients indicated on the Reportable Ingredients List?
If you answered affirmatively to these three questions, then you are concerned by the new requirements and you must follow the next actions.
Identify the products you must report by consulting the updated Reportable Ingredients List (check the list). Any cosmetic product sold in California containing an ingredient indicated on this list must be reported to the California Department of Public Health.
This list contains three different kinds of ingredients considered as hazardous:
CMR (including unbound particles of respirable size of titanium dioxide or crystalline silica, non-decolorized aloe vera, etc.)
Prop 65 listed substances
Fragrance allergens if ≥ 0.01% in a rinse off cosmetic product or ≥ 0.001% in a leave-on cosmetic product

UCC’s tip: Be aware that the following information will be asked when reporting your ingredient/product, we recommend you to compile these information before starting the online process of registration:
- Company name
- Brand name
- Product name
- Variation name
- Company’s internal product ID
- Universal Product Codes (UPC)
- Product’s website address
- Product marketing photo
- Product’s intended market
- Product’s intended application area (face, hands, etc.)
- Product’s physical form (cream, powder, spray, etc.)
- List of the product’s manufacturers
- Product formulation information from manufacturer(s) and supplier(s) needed to identify all reportable ingredients
